Conditions of Acceptance (1)

The following are the conditions under which we accept advertisements:-


The Berkshire Express web site is operated by Goldwater Systems Ltd, company no. 3254886 registered in the United Kingdom. For the address see the "Contact Us" page of this site.

The terms "we", "us" and "our" where used below refer to Goldwater Systems Ltd.

The advertisements - We operate a service to display advertisements (directory entries) as notified to us. We are not able to verify the truthfulness or otherwise of any advertisement on this site, and we accept no responsibility for the accuracy or otherwise of the information displayed.

Liability - The person or company placing an advertisement shall be liable for all claims in respect of any untrue statement in the advertisement whether deliberate or otherwise.

Unacceptable industries - We will not accept advertisements from businesses or organisations dealing primarily in, or display advertisements which feature:- gambling, pornography, armaments, or tobacco. We also do not accept entries from religious or political organisations. We reserve the right to refuse entries from other businesses at our sole discretion.

Content - No advertisement may include anything that is, or is in our opinion, illegal, defamatory, untrue, pornographic, or likely to cause offence in some other way. In this regard we consider that this site may be viewed by children and we may edit or even disallow entries for this reason. We reserve the right to amend, or delete, any advertisement in order to comply with these requirements without reference to the advertiser. Any monies paid will be refunded in such a situation.

Outward links - All other sites linked to from this site are the responsibility of their respective owners, and we can not be held responsible for the content appearing on such other sites. The owners and/or editors and/or administrators of any site linked to from this site are entirely responsible for any claims made concerning the content of their site.

Acceptance - "Acceptance" in these Conditions means our processing and displaying the advertisement, and no contract for a paid advertisement is entered into until the advertisement has been displayed on the site and payment if applicable received. The initial automatic computer responses from the site when you submit the advertisement to us do not constitute acceptance.

Cancellation - In the event that we cancel or refuse to accept any advertisement for any reason, or if we fail to display any advertisement for any reason, we will return or refund the payment made to us for that advertisement for the current period of the advertisement (normally meaning the current year for annually renewable advertisements).

Categories - From time to time it may be necessary to amend classification categories in order to present the entries in the best possible way to the users. In particular, if the number of entries in a category becomes too large, we may look for a suitably logical way to divide it. This will be done in order to benefit the users, which in itself is likely to benefit the advertisers. We therefore reserve the right to change our classification categories, to rename them, or split them or merge them, as seems best in our view for the sake of the users of the directory.

Editing category - We reserve the right to move any advertisement to a different category if we deem that it has been incorrectly classified by the advertiser. We will notify the advertiser if this is done to a paid for advertisement, and will refund pro rata from the date of the move, or the complete price paid if the move is done within one month of placing the advertisement, if the advertiser prefers not to continue the advertisement in the new category.

Editorial - In order to preserve a standard look and feel across this directory we will edit advertisements where necessary, in our opinion, to preserve the look we want without reference to the advertiser. For instance we do not show ads with the company name written entirely in block capitals (except where a company name consists of initials and is normally shown in capitals, e.g. the RAC). Likewise we will normally edit the text of an advertisement to remove overuse of capitals, capital initials, multiple dashes, hyphens, slashes etc. We also correct grammer and spelling where appropriate. Addresses are normally shown by reference to the Post Office directories according to postcode, which may differ slightly from the form the advertiser entered them.

Scope of publication - By submitting an advertisement to this site you consent to and agree that any details you include in it of addresses and/or telephone numbers, and the advertisement details, will be displayed to anyone viewing the site, which may include people anywhere in the United Kingdom and around the world.

Appearance - This site is optimised for display using the major web browsers. However quirks in those browsers may cause unexpected effects when displaying any web site, and other browsers may also have their own idiosyncrasies; surfer's own browser settings likewise affect the issue, so this web site is not guaranteed to show all advertisements in the expected manner at all times.

Conditions of Acceptance (2)

 Publication date - While we will make every endeavour to ensure an advertisement is processed in accordance with our stated time scales, we can make no guarantee of this and we cannot accept any responsibility for any loss or damage incurred due to any delay in publication for whatever cause.

Accuracy - It is the responsibility of the person or company placing an advertisement to ensure it is correct, and to check it once it has been published on this site.

Editing - Notwithstanding the previous condition, we will normally correct spelling mistakes in a submitted advertisement, if they come to our attention, in accordance with English spelling.

Non-display - Our responsibility for any loss or damage incurred by an advertiser due to loss of, or failure to display, or incorrect display of an advertisement will be limited to a refund to the advertiser of the payment made. We do not accept any responsibility for any adverse effect on a business, howsoever caused,

Downtime - While we endeavour to keep this site operating 24 hours a day, it is technically impossible to guarantee that any web site will not be subject to failure, and there is always the possibility of down time due to circumstances not under our control. We will not make refunds for such down time on paid for advertisenments unless, in our opinion, such down time was so excessive (meaning whole weeks lost) as to seriously affect advertisements placed. Claimed adverse effect on a business will not be considered a reason for compensation. Any compensation will be limited to the amount paid to us for the advertisement.

Sale of data - We do not currently supply any data submitted to this site to any other organisation or person other than by displaying it on, and allowing printing from, this site (except as might be required by lawful authorities in a particular case and normally requiring the authority of the courts.). If we change this policy at any time in the future, this condition will be removed, but such change in policy will only be applied to data received after such removal. Advertisers should be aware that copies of parts of any web site can be printed or downloaded by viewers and retained by them whether legally or otherwise.

Disputes - In the unlikely event that a query or dispute cannot be resolved to the satisfaction of both parties, or if we cannot accept an entry for any reason (e.g. if you operate in one of our rejected business types), we will return your payment immediately without further obligation. (If you are in any doubt to begin with about the content of your ad, please contact us beforehand with your query.)

Delay - In the event of any delay (by either party) the period of an advertisement will always count from the date of actual publication to ensure you get the full period.

Guarantee - We operate a 1 month guarantee - if you are not happy with your entry and wish to cancel it within one month of publication, we will refund your money without question.

Governance - These Terms and Conditions, and any contract to display an advertisement, shall be governed by English law.
